Grand Theft / Larceny

Grand theft / larceny is the taking of anything valued at greater than $200 with the intent to permanently deprive the owner of its use. Grand theft is an unclassified felony that carries not less than one year and up to 20 years in prison. Probation may be given for this offense at the discretion of the judge.

Grand theft / larceny can take many forms. It can be shoplifting from a store, a theft from an individual or business or any number of other circumstances.

There can also be a companion charge in these types of cases depending on the circumstances. Possession of burglary tools is often an additional charge that can be brought which is a class five felony and carries not less than one year and up to ten years in prison.

The main issues that arise in these cases usually revolve around identification of evidence, chain of custody, video and surveillance footage, confessions and statements made to loss prevention officers and sometimes eyewitness testimony.
